Welcome to Unhook, operated by Lexom Inc. ("Lexom", "Unhook", "we", "us", "our"). These Terms and Conditions ("Terms") outline the rules and regulations for using our application and services. These Terms, together with our Privacy Policy and Subscription Terms, form the complete agreement between you and Lexom Inc.

1. Acceptance of Terms

By downloading, installing, or using Unhook, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and (if you subscribe to premium features) our Subscription Terms. If you do not agree with any part of these terms, please do not use our Service.

2. Important Health and Wellness Disclaimer

Unhook is a digital wellness tool designed to support users in building healthier habits. It is important to understand that:

• Unhook does not provide medical advice, diagnosis, treatment, therapy, counseling, or professional addiction recovery services
• The App is not a substitute for professional healthcare, therapy, or counseling
• Use of the App does not create a doctor-patient or therapist-client relationship
• No specific results, sobriety outcomes, habit changes, or health improvements are guaranteed
• Individual results vary widely and depend on many factors beyond the App

Always consult qualified healthcare professionals (e.g., physicians, therapists, counselors, or addiction specialists) for personalized advice. Seek immediate professional help in cases of crisis, severe distress, or emergency. Do not rely solely on the App for managing addiction, mental health, or any related condition.

3. Age Requirements

Unhook is available to users aged 13 and above. The app contains no adult content, nudity, or explicit material. We focus solely on providing tools and support for building healthy habits and tracking progress.

Users between the ages of 13 and 17 must have the consent of a parent or legal guardian to use the App. By creating an account on behalf of a minor, the parent or guardian agrees to these Terms on the minor's behalf and accepts responsibility for the minor's use of the App.

4. Account Creation and Security

When creating an account, you must provide accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information remains current

5. Subscription and Payments

Unhook offers both free and premium features through auto-renewable subscription plans processed via Apple's App Store. For complete details on billing, auto-renewal, cancellation, refunds, free trials, and pricing, please refer to our Subscription Terms.

6. Community Guidelines

Our community thrives on mutual support and respect. Users must:

• Foster a supportive and encouraging environment
• Respect privacy and confidentiality
• Share only appropriate, recovery-focused content
• Help maintain community safety by reporting concerns
• Avoid self-promotion or commercial activities
• Engage in constructive, respectful dialogue

6.1 Content Guidelines and Moderation

Users must not post content that:

• Contains sexually explicit material or pornography
• Promotes violence, self-harm, or hatred
• Includes harassment, bullying, or threatening language
• Violates others' privacy or intellectual property
• Contains illegal content or promotes illegal activities
• Includes spam, scams, or misleading information

We employ automated moderation tools powered by OpenAI that may flag and remove prohibited content without prior notice. Our system:

• Automatically screens all user-generated content
• Removes content that violates our guidelines
• May temporarily restrict posting privileges for policy violations
• Can lead to account suspension for repeated or severe violations

If you believe your content was incorrectly moderated, you may appeal the decision through our support channels. We will review appeals within 10 business days. We reserve the right to make final decisions on all content moderation matters.

6.2 User Interactions

You are solely responsible for your interactions with other users. Lexom Inc. does not screen, vet, or endorse any user and is not liable for any damage, loss, or harm arising from your interactions with other users, including harassment, bullying, or emotional distress caused by another user's content or conduct. If you experience harassment or feel unsafe, please report it through the App's reporting features or contact us at hello@getunhook.com.

6.3 AI-Powered Features

Unhook uses artificial intelligence, including third-party AI services (such as OpenAI), to power certain features including the "Lumina" chatbot and automated content moderation. You acknowledge and agree that:

• AI-generated responses may contain errors, inaccuracies, or incomplete information
• AI responses do not constitute medical advice, therapy, counseling, or professional addiction recovery guidance
• AI features are provided for general informational and support purposes only
• You should not rely on AI-generated responses for health, wellness, or recovery decisions
• Lexom Inc. is not liable for any harm resulting from reliance on AI-generated content

7. Intellectual Property

Unhook's content and technology are protected by intellectual property laws:

• All trademarks, logos, and brand features are our exclusive property
• App content and design elements are copyright protected
• Our recovery methodology and features are proprietary
• User-generated content rights are retained by users, with a limited, non-exclusive, royalty-free license granted to us to display and distribute such content within the App

8. Content Rights

All content within Unhook, including but not limited to text, graphics, logos, and software, is our exclusive property. You may not:

• Copy or modify the app or its content
• Reverse engineer the software
• Remove copyright or trademark notices
• Use our content for commercial purposes

9. Disclaimer of Warranties

Unhook is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The App will be error-free, uninterrupted, or free of harmful components
• All features will be available on all platforms
• The App will meet your specific needs or expectations
• All content will be completely accurate or up to date
• The App will produce any particular health, wellness, or recovery outcomes

Nothing in these Terms excludes or limits any rights you may have under the Consumer Protection Act, 2002 (Ontario), the Competition Act (Canada), or other applicable consumer protection legislation that cannot be excluded or limited by contract.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Lexom Inc., its affiliates, officers, directors, employees, agents, and licensors ("Protected Parties") shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

• Loss of data, profits, or goodwill
• Health outcomes, emotional distress, or medical costs
• Addiction-related harm or reliance on the App
• Service interruptions or technical issues
• Content or resources accessed through external links

Our total aggregate liability for any claims arising from or related to these Terms or your use of the App shall not exceed the greater of (a) the amount you paid to Unhook in the 12 months preceding the claim, or (b) $100 USD. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those cases, our liability is limited to the maximum extent permitted by law.

11. Indemnification

To the extent permitted by applicable law and not resulting from Lexom's own negligence or willful misconduct, you agree to indemnify, defend, and hold harmless the Protected Parties from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your misuse of the App in violation of these Terms
• Violation of any applicable law
• Any content you submit or share within the App
• Your infringement of any third-party rights

This indemnification obligation does not apply to users who are minors under the laws of their jurisdiction.

12. Termination

Account termination may occur under these circumstances:

• Violation of these Terms or community guidelines
• Extended period of account inactivity
• At user's request for account deletion
• Legal or regulatory requirements

Upon termination, your right to use the App ceases immediately. If you have an active paid subscription at the time of termination, see Section 9 of our Subscription Terms for details on premium access. For information about data retention and deletion following termination, see Section 8 of our Privacy Policy.

Provisions that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and governing law) shall continue in full force.

13. Service Availability

Unhook is currently available for iPhone, iPad, and Apple Watch. We regularly release updates to improve the App's functionality and security. While we strive for continuous service, we may:

• Modify or discontinue features with notice
• Require app updates for continued use
• Experience temporary service interruptions
• Expand to additional platforms in the future

14. Force Majeure

Lexom Inc. shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, labor disputes, power failures, internet or telecommunications outages, third-party service provider failures (including Apple, Google/Firebase, and OpenAI), cyberattacks, or other force majeure events. During any such event, our obligations under these Terms are suspended for the duration of the event.

15. Third-Party Links and Content

The App and our website may contain links to third-party websites, services, or resources that are not owned or controlled by Lexom Inc. We do not endorse and are not responsible for the content, privacy practices, or availability of any third-party sites or services. You access third-party content at your own risk and subject to those third parties' terms and conditions. AI-generated responses may reference third-party resources; such references do not constitute endorsement by Lexom Inc.

16. Privacy

Your privacy matters to us. Our Privacy Policy details how we collect, use, and protect your personal information. By using Unhook, you consent to our privacy practices as described in our Privacy Policy.

17. Dispute Resolution

In case of disputes arising from these Terms or your use of the App:

• We encourage direct communication for resolution — contact us at hello@getunhook.com
• If direct resolution fails, disputes shall be resolved through mediation in the Province of Ontario, Canada
• If mediation is unsuccessful, disputes shall be submitted to the exclusive jurisdiction of the courts of the Province of Ontario
• You retain the right to seek legal remedies available under applicable law
• If you are a consumer in the European Economic Area, nothing in these Terms affects your mandatory rights under the consumer protection laws of your country of residence

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in the Province of Ontario, Canada. If any provision of these Terms conflicts with mandatory laws in your jurisdiction, those mandatory laws prevail to the extent of the conflict.

19. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App, via email, or other reasonable means. Continued use of the App after changes take effect constitutes your acceptance of the updated Terms.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy and Subscription Terms, constitute the entire agreement between you and Unhook regarding your use of the App. These Terms supersede any prior agreements or understandings, whether written or oral.
